Special Meeting
August 3, 2017
6:30 p.m.

The Planning and Zoning Special meeting was called to order at 6:45 p.m. with Randy Dalton presiding.

Present at Roll Call: Randy Dalton, Jason Suckut, Kurt Sheehy, and Deb Biegger.

Other’s Present: Zach Dalton, Chad Carpenter, and Becky Roorda.

The Board discussed whether or not fences need to be regulated by a building ordinance. The board stated the City made the decision approximately fifteen (15) years ago to no longer require fencing permits, but felt it was worth researching how other communities handle the issue. This item will be tabled until a later date.

Zach Dalton approached the committee about rezoning 501 S. Milwaukee St. from residential to commercial. The property is an empty lot surrounded on two sides by commercial property. Zach has spoken with Lee Barclay and Rod Dalton, the neighbors within 250 feet of the property regarding the zoning request. Randy stated an Zach would need an affidavit signed by both property holders stating they were in agreement with the rezoning request.
Motion by Sheehy, seconded by Suckut to approve the rezoning request.
Ayes: All Present Motion Carried

Safe Building wanted confirmation that Chad and Mary Carpenter, 406 E. 6th St., be allowed to rebuild their house on the existing foundation. The current foundation is too close to the lot line. This lot would be considered legally non-conforming and building code currently states that non-conforming buildings that have been destroyed by 60% or more comply with all zoning provisions, which would require different setbacks. Motion was made by Sheehy, and seconded by Dalton to approve the Carpenter’s to rebuild their house on their existing foundation.
Ayes: All Present Motion Carried

Chad Carpenter approached the Board regarding issues adding onto his shop located at 210 S. Kennedy. This issue is the size of the addition being on a floating slab. Carpenter has been given permission to pour a concrete slab, which is being done Aug 7, 2017, but not add onto the building. Dalton had a conversation with Safe Building regarding this and they agreed that slab to slab was OK for the building addition. Randy Dalton said that he would contact Safe Building in the morning to find out the status of the building permit. If the permit is denied, Dalton will present the matter at next Board of Adjustment meeting.

Randy Dalton brought up an issue regarding Southern Prairie Drive. He stated that before the approval for the final plat was given for the Southern Prairie development, Roger Wheeler agreed to a 5’ walkway on the west side of Continental Labs and the last property on Southern Prairie Dr. as well as sidewalks on both sides of the street and a painted cross-walk to the walkway to allow for foot traffic from the residents on Southern Prairie Dr. to Edgewood Park. Dalton stated the work was never completed and he wanted it on record that this needs to be addressed.

Motion by Suckut, seconded by Sheehy to adjourn the Planning and Zoning Meeting at 7:17 p.m.
